This website is operated by The Velvet Ember. Throughout the site, the terms "we," "us," and "our" refer to The Velvet Ember. By using our website, you engage in our "Service" and agree to be bound by the following terms and conditions.

2. Product Availability

All products are subject to availability. While we make every effort to ensure accurate inventory and stock levels, we cannot guarantee that a product will always be available at the time of purchase.

In the case of a pre-order, you agree to the timeline outlined during checkout and acknowledge that delays may occur.

3. Pricing and Payments

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue a product at any time. All prices are listed in USD unless otherwise noted.

We accept various payment methods. By placing an order, you represent and warrant that you have the legal right to use the payment method provided.

4. Shipping and Delivery

We strive to process and ship orders promptly. Shipping times may vary depending on your location and the shipping method selected at checkout.

5. Returns and Refunds

If you are not satisfied with your purchase, we accept returns under specific conditions. Products must be unused, in their original packaging, and returned within 20 days of delivery. Approved refunds are issued to the original payment method.

Certain products, including final sale items and customized orders, may not be eligible for returns. Shipping & handling costs are non-refundable.

6. Product Warnings and Use

Our candles are designed with safety in mind, but improper use can cause harm. Please read and follow the safety instructions included with each product.

  • Never leave a burning candle unattended.
  • Keep candles out of reach of children and pets.
  • Burn candles on a heat-resistant, stable surface, away from flammable materials and objects.
  • Trim the wick to 1/4 inch before each burn.
  • While it is possible to burn them longer, we recommend not to burn your candle for no more than 4 hours at a time for safety reasons.
  • Discontinue use when 3/8 inch of wax remains at the bottom of the container.

The Velvet Ember is not responsible for damages or injuries resulting from improper use of our candles.

7. Intellectual Property

All content, designs, trademarks, and intellectual property displayed on this website are owned or licensed by The Velvet Ember. Reproduction or misuse of any content without written permission is strictly prohibited. We are very protective of our work and IP which includes our product descriptions and ALL TEXT on our website. Copying any portion of our content without permission will result in us filing copyright takedown notices with your hosting provider and may result in the deletion of your account and it's contents. 

8. Limitation of Liability

We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our products or website. Our liability is limited to the maximum extent permitted by law.

These Terms of Service are governed by the laws of the state in which we operate which is California. Any disputes will be resolved under these laws.
